Intermec Community Terms of Service

Following are the Terms of Service (TOS) for the Intermec Forum. Use of the Intermec Forum Site indicates you accept these terms. If you do not accept these terms, do not use the Intermec Forum Site.

Purpose
The Intermec Forum Site (hereafter "Service") is a peer-to-peer support channel for people developing applications and solutions on Intermec products. This community is for our customers, partners, and other enthusiasts.
Although this community is designed for Intermec customers and users, we welcome everyone with an interest in developing applications and solutions on Intermec products, as long as you observe the rules of conduct set forth in these TOS.

Conduct
You may not use your registration membership (or allow anyone else to use your registration membership) to post or transmit any of the following:

  1. Content that is abusive, vulgar, obscene, hateful, fraudulent, or that discloses private or personal matters concerning any person. This includes language, information, or images.
  2. Content that is threatening, defamatory or abusive, either between Forum members or directed towards a Forum moderator, or an Intermec employee or manager.
  3. "Rants," "slams," or legal threats against Intermec, another company, or other users. This includes "flaming", stalking, and or harassment.
  4. Bigoted, hateful, or racially offensive comments.
  5. Political or religious statements or commentary.
  6. Off-topic comments not related to enterprise communities or Intermec products.
  7. Any material that you don't have the right to transmit under copyright, trade secret or securities laws or under contractual or fiduciary relationships (such as nondisclosure agreements).
  8. Language that promotes illegal activity or discusses illegal activities with the intent to commit them. This includes any message that solicits or promotes the use of an illegal substance.
  9. Advertising, promotional materials, or other forms of solicitation including chain letters, pyramid schemes, class actions, charitable appeals, advertising links in signatures, links to advertising, spam, or referrals, links to charitable organizations or sponsorships, links whose purpose is to drive traffic to another Site or links to "vote for my friend."
  10. Any file or link to a file that contains viruses, corrupted files, "Trojan Horses," or any other malicious code that contaminates, destroys, or that may damage someone else's computer or data.
  11. Duplicate posts, spam messages, or posts repeated excessively on one or more boards.
  12. Messages designed to evade profanity or other filters.
  13. Personal phone numbers or addresses (to protect privacy).
  14. Personal email addresses, private information such as social security numbers, or other contact information that is not your own, including, but not limited to e-mail addresses of Intermec employees.
  15. Hyperlinks that lead to Sites that violate any of the Forum TOS.
  16. Any message that impersonates another person or an affiliation with an entity, including, but not limited to, Intermec.
  17. Cryptic messages used to evade bans or suspensions or otherwise disregarding directions from Forum moderators or administrators.
  18. Material from multiple identifications.
  19. Material that could be a potential violation of the Digital Millennium Copyright Act or which infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  20. Materials that may interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
  21. Material that intentionally or unintentionally violates any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
  22. Material on reverse engineering and or materials analysis of Intermec products.

You agree that you will not take any actions which interfere in any way with the operations of the Service or with a another user's message box, including but not limited to mail or "post" bombing, news bombing, other flooding techniques, deliberate attempts to overload a system and broadcast attacks, or attempts to avoid messaging blocking.

Forum moderators may at any time and without prior notice remove any posted message or thread, delete words that violate these guidelines from posted messages, or terminate your account for violating the above reasonable provisions.

You acknowledge and agree that Intermec may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Service (TOS); (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Intermec, its users and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Please remember that you are responsible for all statements made and acts that occur through the use of your user name and password. If you recognize any violation of these guidelines, please notify us by using the "report abuse to moderator" feature in the Options menu of the message, or by contacting us directly at communitysupport@intermec.com.

Copyright Infringement

In accordance with the Digital Millennium Copyright Act, your notification must include:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online Site are covered by a single notification, a representative list of such works at that Site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

User Profile Information
We may reject in our sole discretion, and you may not use, a screen name or email address that is already being used by someone else, that impersonates another person, that belongs to another person (without that person's prior consent), that violates the intellectual property or other rights of any person, or that is vulgar or otherwise offensive.

In consideration of your use of the Intermec Forum Site you agree that all information provided in your profile is accurate, true, current, and complete. Intermec may terminate your account if any of the information provided is found to be inaccurate, false, out of date, or incomplete.

Member Generated Content
The content found in the Intermec Forum Site comes from a variety of sources, primarily from community members. Intermec makes no claims or representations as to the accuracy, completeness, or truth of any material submitted or found in the discussion areas. Intermec is not liable for any website links posted within the discussion areas. Website links posted in the discussion areas may link to Sites not administered or under the control of Intermec and users open such links at their own risk. Intermec is not liable for any errors or delays in the content or transmission of postings on the Site. Remember that you are responsible for your own decisions to act upon the information made available on the Site.

Intermec makes no guaranty of the confidentiality or privacy of any communication or information transmitted on the Site, or any web-site linked to the Site, or otherwise in connection with the Service and Intermec will not be liable for the privacy of e-mail addresses, registration and identification information, confidential or trade-secret information.

Special Admonitions for International Use
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside and any applicable data privacy laws.

Content Submitted or Made Available for Inclusion on the Service
Intermec does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant Intermec the following world-wide, royalty free and non-exclusive license(s), as applicable:

  • With respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant Intermec the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service. This license exists only for so long as you elect to continue to include such Content on the Service and will terminate at the time you remove or Intermec removes such Content from the Service.
  • With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible area of the Service, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service solely for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or Intermec removes such Content from the Service.
  • With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service, the perpetual, irrevocable and fully sub-licensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

"Publicly accessible" areas of the Service are those areas that are intended by Intermec to be available to the general public. By way of example, publicly accessible areas of the Service would include Intermec Message Boards that are open to both members and visitors. However, publicly accessible areas of the Service would not include portions of Intermec that are limited to members.

The use of the Private Messaging Service is not "Private" in the sense that it is a message seen only by the sender and receiver. While the message is private from the rest of the members, it is not encrypted and the administration of Intermec can view them if needed from the database. All rules that apply to posting on the Forums ALSO apply to the use of our Private Messaging System and violators may have their posting privileges subject to the same revocations as on the Forum in general.

Unauthorized Use
If your user identification or password(s) is compromised, or if you become aware of any unauthorized use of your account or other breach of security, you are responsible for promptly notifying us. You can notify us by sending an email to communitysupport@intermec.com.

Age
You must be 13 years of age or older to access the Intermec Forum Site.

Language
The language of the Intermec Forum Site is English.

Modifications
Intermec reserves the right without notice to discontinue this Service or suspend this Service temporarily. Intermec also reserves the right to modify these TOS at any time, effective upon posting of the modified TOS on the Forum. Intermec is not liable to you or any third party for the modification, suspension, or termination of this Service.

No Resale of Service
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

General Practices Regarding Use and Storage
You acknowledge that Intermec may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on Intermec's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Intermec has no responsibility or liability for the deletion or failure to store any messages and other communications or other content maintained or transmitted by the Service. You acknowledge that Intermec reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Intermec reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Disclaimer of Warranties
The Service is provided on an "as is" basis without warranty of any kind, express or implied. You expressly agree that the use of the Service is at your sole risk. Intermec does not warrant that the Service will be uninterrupted or error free, nor does Intermec make any warranty as to any results that may be obtained by use of the Service. Intermec makes no other warranties, expressed or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose, in relation to the Service.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM INTERMEC OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY.

Termination
You agree that Intermec, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Intermec believes that you have violated or acted inconsistently with the letter or spirit of the TOS. Intermec may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Intermec may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Intermec shall not be liable to you or any third-party for any termination of your access to the Service.

Dealings with Advertisers
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment for and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Intermec shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Links
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Intermec has no control over such sites and resources, you acknowledge and agree that Intermec is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Intermec shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Intermec Proprietary Rights
You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Intermec or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

Trademark Information
The word "Intermec," and the Intermec logo, trademarks and service marks, and other Intermec logos and product and service names are trademarks of Intermec (the "Intermec Marks"). Without Intermec's prior permission, you agree not to display or use in any manner, the Intermec Marks.

Limitation of Liability
Under no circumstances shall Intermec be liable to you or any other person for any damages, including without limitation, direct, indirect, incidental, consequential or punitive damages arising out of or relating to this agreement or the use of the Service or Site. Your sole and exclusive remedy hereunder shall be for you to discontinue your use of the Service and terminate this agreement.

Indemnification
You agree to indemnify, hold harmless and defend Intermec, its shareholders, directors, officers, employees and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorney's fees, asserted by any person, arising out of or relating to: (a) these TOS; (b) your use of the Intermec Forum Site, including any data or work transmitted or received by you; and (c) any libelous, slanderous, indecent or other statement concerning any person made or republished by you.

Governing Law and Venue
These TOS constitutes a binding agreement. Failure to comply with these TOS may result in account revocation and other legal action. These TOS and related documents set forth herein constitute the entire agreement between you and Intermec and govern your use of the Intermec Forum Site superseding any prior agreements between you and Intermec. The laws of the State of Washington, U.S.A., shall govern the TOS and the relationship between you and Intermec, without regard to conflict of law provisions. You and Intermec agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Snohomish, Washington, U.S.A.
